170.30 INFILL

DEVELOPMENT OVERLAY DISTRICT IDOD.

1.   General Description and Purposes of District. The Infill Development Overlay District (IDOD) has been established to encourage infill and redevelopment in the older residential area to include parcels of land that do not meet the minimum dimensional requirements of the Zoning Code as well as those that do meet the minimum requirements. It has been established to encourage development that maintains the character of existing neighborhood buildings and structures; to permit a flexible approach to providing single-family houses; and to foster well-planned, modest homes in a residential area in keeping with the visual character of the neighborhood.
   A.   Allowing development of single-family homes in close proximity to each other within the district and within a limited area;
   B.   Preserving and restoring the overall character of the identified overlay district area;
   C.   Promoting a balance of home sizes;
   D.   Promoting the opportunity for people to develop residences in areas of land that would not otherwise be developed;
   E.   Promoting a high level of design quality; and
   F.   Facilitating development proposals responsive to current and future market conditions.
2.   Principal Uses Permitted. Property and buildings in the Infill Development Overlay District (IDOD) will be used only for the following purposes:
   A.   Single-family detached dwelling, either site-built or pre-fabricated modular home, providing compliance with the provisions of the following subsections on density, floor area ratio, and minimum dwelling size.
   B.   Accessory uses or building which are customarily incidental to any of the above stated use.
   C.   Planned Development District (PDD).
3.   Special Exceptions. The following principal uses may be permitted as special exceptions by the Board of Adjustment in accordance with the provisions contained herein:
   A.   Church, temple, synagogue, or mosque.
   B.   Childcare center.
   C.   Two-family dwellings, assuming underlying zoning district is either R-2 or R-3.
   D.   Home occupation.
   E.   Municipal administrative or public service building or properties, except storage yards, warehouses, or garages, connected therewith.
   F.   Park, playground, or community center.
   G.   Public library and similar public culture uses.
   H.   Public school or private school offering general educational courses the same as ordinarily given in public schools.
   I.   Public utility service facilities - such as, but not limited to, gas regulator station, telephone exchange, electric substation, water tower or well, sanitary sewer lift stations and treatment facilities, and telecommunication facilities.

4.   Height Regulations. No principal building or structure will exceed 35 feet in height and no accessory structure will exceed the elevation of the principal building as verified by a State licensed professional engineer.
5.   Lot Area, Lot Width, and Yard Requirements. Lot area and yard requirements are significantly more flexible than the traditional requirements of the Single-Family Residential District (R-1), under the stipulations that the lot and dwelling will not create additional nuisances towards neighbors, and will meet other additional development standards of the Infill Development Overlay District, including:
   A.   The proposed building or structure is consistent in architectural style, scale, setbacks, and frontage with abutting structures, and those in the immediate neighborhood.
   B.   Each lot will have access and utility service comparable to that serving nearby properties.
   C.   No traffic congestion, health, or safety limitations would be created by the development.
   D.   Access shall be provided to the extent feasible through an existing side street or a shared driveway; curb cuts shall be minimized.
   E.   Lot area. The following minimum lot area requirements will apply:
      (1)   5,000 square feet.
   F.   Lot Width and Yard Requirements. The following minimum lot width and yard requirements will be observed:
      (1)   Lot Width   60 feet.
      (2)   Front Yard Depth   25 feet.
      (3)   Side Yard Minimum Width   5 feet.
      (4)   Sum of Side Yard Widths   10 feet.
      (5)   Rear Yard Depth   30 feet.
6.   Density. The allowable residential density in this zoning district will not exceed 9.3 dwelling units per acre, except under the provisions of a PDD.
7.   Floor Area Ration. The allowable floor area ratio in this zoning district will not exceed 0.4.
8.   Minimum Size of Dwelling. Each single-family detached dwelling and any other structure occupied, in whole or in part, for residential purposes will contain at least 1,000 square feet of finished square feet.
9.   Minimum Spacing Between Buildings. The minimum horizontal distance between any buildings will be 10 feet for single-family dwellings.
10.   Minimum Structure Width. The minimum dimension (width) of the main body of any residential structure will not be less than 22 feet for at least 75 percent of the distance of the major dimension (length).
11.   Parking Standards. Newly constructed homes in the Infill Development Overlay District shall include off-street parking amenities for at least two vehicles. A continuous parking surface such as concrete, asphalt, paver bricks, or other alternative materials that are shown to be impervious yet as durable as concrete pavement.
12.   Commonly Held Adjacent Lots. Any lot that is commonly held in ownership with an adjacent lot in this district may be treated as a single lot in accordance with this Code, provided that the total area of such lots is at least 5,000 square feet in area, the lots have a combined contiguous frontage of at least 60 feet, and vacant of structures, parking facilities, or accessory uses. Additionally, an exceptionally large lot in the Infill Development Overlay District may be re-platted into two separate lots if each adjacent lot meets the minimum requirements outlined above.
13.   Infill Overlay District (Areas Defined on Map). The Infill Overlay District is hereby established within the City, as defined by the corresponding map in the Zoning Code.
