170.22 NEIGHBORHOOD

COMMERCIAL DISTRICT C-1.

1.   General Description. This commercial district is for the conduct of retail trade and personal service enterprises to meet the regular needs and for the convenience of the people of adjacent residential areas. Because these shops and stores may be an integral part of the neighborhood closely associated with residential, religious, recreational, and educational uses, more restrictive requirements for light, air, open space, and off-street parking are made than are provided in other commercial districts.
2.   Principal Uses Permitted. Property and buildings in a Neighborhood Commercial District (C-1) will be used only for the following purposes:
   A.   Any use permitted in the Multi-Family Residential District (R-3) and any use permitted on review in the Multi-Family Residential District (R-3), except that all residential dwellings will be located in multiple use buildings above the ground floor and will be secondary to the business use of the premises.
   B.   Antique shop.
   C.   Art and school supply store.
   D.   Attorney’s and law offices.
   E.   Bank, savings and loans, and other financial institutions, including drive-up facilities.
   F.   Barber shop.
   G.   Beauty parlor.
   H.   Book or stationary store.
   I.   Camera shop.
   J.   Candy store and confectionery store.
   K.   Childcare center and preschool.
   L.   Chiropractor’s office.
   M.   Community center.
   N.   Currency exchange.
   O.   Dairy products or ice cream store.
   P.   Dental office or drug store.
   Q.   Dry cleaner, but not a central plant servicing more than one retail outlet.
   R.   Dry goods store.
   S.   Florist shop.
   T.   Food store, grocery store, meat market, bakery, (in which manufacturing of goods is limited to goods sold on the premises only), and delicatessen.
   U.   Gift shop.
   V.   Insurance office/agency.
   W.   Jewelry store.
   X.   Laundry and dry cleaners, self-service only.
   Y.   Municipal administrative or public service office.
   Z.   Music and dancing studio.
   AA.   Off-street parking facility for public and quasi-public office buildings.
   BB.   Optometrist sales and services.
   CC.   Package liquor sales.
   DD.   Photographer or artist studio.
   EE.   Planned Development District.
   FF.   Post office.
   GG.   Professional and business office.
   HH.   Public library and similar public culture uses.
   II.   Public and quasi-public office buildings.
   JJ.   Real estate office.
   KK.   Restaurant, excluding drive-in restaurant.
   LL.   Self-service laundry or dry cleaning.
   MM.   Shoe repair shop and shoe store.
   NN.   Sporting goods store.
   OO.   Tailor shop and dressmaker.
   PP.   Toy store.
   QQ.   Variety store.
   RR.   Clothing and apparel store.
   SS.   Accessory uses or buildings customarily incidental to any of the above uses.
3.   Special Exceptions. The following principal uses may be permitted as special exceptions by the Board of Adjustment in accordance with the provisions contained herein:
   A.   Automobile service station, for the sale of gas, lubricants, coolants, minor accessories, and pre-packaged food goods only, and the performance of incidental services such as tire changing, battery charging, and accessory installation.
   B.   Drive-in banking facility (ATM).
   C.   Private club or lodge.
   D.   Any other use determined by the Board of Adjustment upon review to be of the same general character as the foregoing permitted uses.
4.   Height Regulations. No principal building or structure or portion thereof will exceed a height of 40 feet and no accessory structure will exceed the elevation of the principal building as verified by a State licensed professional engineer.
5.   Lot Area, Lot Width, and Yard Requirements.
   A.   Lot Area. None required, except that the minimum lot area requirements for structures containing dwelling units are the same as those in the Multi-Family Residential District (R-3). (See Section 170.20(5)).
   B.   Lot Width and Yard Requirements. The following minimum lot width and yard requirements will apply:
      (1)   Lot Width:   None.
      (2)   Front Yard Depth:   25 feet.
      (3)   Side Yard Widths:   None, except where adjoining a residential district, then same as the least width required in that residential district.
      (4)   Rear Yard Depth:   10 feet, except where adjoining an residential district, then same as required in that district.
6.   Special Provisions.
   A.   Scope of Operations. All business establishments will be retail trade or service establishments dealing directly with consumers, and all goods produced on the premises will be sold on the premises where produced.
   B.   Enclosure of Operations. All business, servicing, (including solid waste collection and storage), or processing will be conducted within completely enclosed buildings or structures, except:
      (1)   Off-street parking or loading.
      (2)   Accessory uses when permitted by a special exception.
   C.   Screening. Where a commercial use abuts or is across the street from a residentially zoned district, adequate screening shall be required by the Planning and Zoning Commission in accordance with Section 170.35.
   D.   Parking Provisions. Parking spaces and areas will be provided in accordance with the applicable regulations set forth in Section 170.52. In addition, the parking of trucks when accessory to the conduct of a permitted use will be limited to vehicles having not over one and one-half tons capacity, except for pick-up and delivery services.
   E.   Performance Standards. All activities will conform with the performance standards established for the Light Industrial District (I-1).
   F.   Sign Requirements. Any sign erected will be done so in accordance with the applicable regulations set forth in Chapter 161.
   G.   Residential Uses. Any and all activities associated with allowable, conforming, residential uses, (including accessory buildings and structures), in this district will conform with those residential requirements as outlined in the Multi-Family Residential District.
7.   Floor Area Ratio. The allowable floor area ratio in this zoning district will not exceed 1.0.
