170.23 CENTRAL

BUSINESS DISTRICT C-2.

1.   General Description. This commercial district is designed to protect and improve the Central Business District for the performance of its function, which is to provide the primary center for commercial, financial, professional, governmental, and cultural activities for the residents of the City.
2.   Principal Uses Permitted. Property and buildings in the Central Business District (C-2) will be used only for the following purposes:
   A.   Any use permitted in the Neighborhood Commercial District (C-1).
   B.   Accounting, auditing, and bookkeeping.
   C.   Appliance store.
   D.   Art gallery, art school.
   E.   Artist and industrial designer.
   F.   Automobile accessories store.
   G.   Automobile service station, (which may include not more than one attached car wash bay).
   H.   Bait shop.
   I.   Bar, cocktail lounge, or tavern.
   J.   Better Business Bureau.
   K.   Bicycle sales, rental, and repair.
   L.   Billiard/pool hall.
   M.   Blueprinting shop.
   N.   Brewpub.
   O.   Bus passenger station.
   P.   Business machines store.
   Q.   Business and management consultant.
   R.   Business office.
   S.   Chamber of Commerce office.
   T.   Charitable organization.
   U.   China and glassware store.
   V.   Civic association.
   W.   Clothing rental agency.
   X.   Convenience store, (may be combined with other permissible uses in this district)
   Y.   Credit agency.
   Z.   Department store.
   AA.   Detective agency.
   BB.   Drapery store.

3.   Special Exceptions. The following principal uses may be permitted as special exceptions by the Board of Adjustment in accordance with the provisions contained herein:
   A.   Any other use determined by the Board of Adjustment upon review to be of the same general character as the foregoing principal permitted uses.
4.   Height Regulations. No principal building or structure will exceed 75 feet in height and no accessory structure will exceed 40 feet in height or the elevation of the principal building as verified by a State licensed professional engineer, whichever is less.
5.   Lot Area, Lot Width, and Yard Requirements.
   A.   Lot Area. None required, except that the minimum lot area requirements for structures containing dwelling units are the same as those in the Multi-Family Residential District (R-3) (See Section 170.20(5)).
   B.   Lot Width and Yard Requirements. The following minimum lot width and yard requirements will apply:
      (1)   Lot Width:   None.
      (2)   Front Yard Depth:   None.
      (3)   Side Yard Widths:   None, except where adjoining a residential district, then same as the least width required in that residential district.
      (4)   Rear Yard Depth:   None, except where adjoining a residential district, then 10 feet is required.
6.   Special Provisions.
   A.   Scope of Operations. All business establishments will be retail trade or service establishments dealing directly with consumers, and all goods produced on the premises will be sold on the premises where produced.
   B.   Enclosure of Operations. All business, servicing, (including solid waste collection and storage), or processing will be conducted within completely enclosed buildings or structures, except:
      (1)   Off-street parking or loading.
      (2)   Accessory uses
   C.   Screening. Where a commercial use abuts or is across the street from a residentially-zoned district, adequate screening shall be required by the Planning and Zoning Commission in accord with Section 170.43.
   D.   Parking Provisions. Parking spaces/areas will be provided, in accordance with the applicable regulations set forth in Section 170.52.
   E.   Performance Standards. All activities will conform with the performance standards established for the Light Industrial District (I-1).
   F.   Sign Requirements. Any sign erected will be done so in accordance with the applicable regulations set forth in Section 170.53.
   G.   Residential Uses. Any and all activities associated with allowable, conforming, residential uses, (including accessory buildings and structures), in this district will conform with those residential requirements as outlined in the Multi-Family Residential District.
   H.   Multiple principal uses and uses permitted by special exceptions are allowed in a single building within this district.
7.   Floor Area Ratio. The allowable floor area ratio in this zoning district will not exceed 0.4.
