170.40 MISCELLANEOUS

LOT PROVISIONS.

1.   Minimum Street Frontage for Lots. No lot will be created after the adoption of this Zoning Code unless it abuts at least 60 feet on a public street except as otherwise provided for herein.
2.   Lots Without Street Frontage. Every structure or group of structures, and every use or group of uses, will be located upon a lot. Where unique land planning designs are employed in a planned development district to conserve the natural character of the land or to create afunctional or compatible arrangement of structures or uses, a lot which does not abut upon a public or private street may be permitted provided that:
   A.   Adequate provision is made for free access to the lot for the property owner, or in the case of a nonresidential lot, for those persons who would normally require access to the lot.
   B.   Adequate provision is made for the unobstructed access of firefighting services, police protection, mail carrier letter service, rubbish collection, and other governmental services.
   C.   Adequate provision is made for the extension and maintenance of public and private utility services.
   D.   The arrangement will not contribute toward congestion in nearby streets as a result of delivery services, lack of guest parking, or other reasons.
3.   Lot of Record. In any residentially zoned district on a lot of record at the time of enactment of this Zoning Code, a single-family dwelling may be established regardless of the size of the lot, provided all other requirements of this Zoning Code are complied with. However, where two or more vacant and contiguous substandard recorded lots are held in common ownership, they may be combined into zoning lots which require a restrictive covenant and agreement not to sever form and will thereafter be maintained in common ownership and will be so joined and developed for the purpose of forming an effective and conforming zoning lot. For the purpose of this section, the razing of a building on a substandard lot will constitute the formation of a vacant lot.
4.   Division of Zoning Lot. No improved zoning lot will hereafter be divided into two or more zoning lots unless all improved zoning lots, resulting from each such division, conform with all the applicable regulations of the zoning district in which the property is located.
5.   Two Uses on a Lot. Where two or more permitted or special uses, each requiring a minimum lot area, are provided in the same building or on the same lot, the required lot area will be the sum of the areas required for each use individually.
6.   Number of Buildings and/or Uses on a Zoning Lot. Except in the case of Planned Development Districts (PDD), or as otherwise allowed herein, not more than one detached, principal building or use will be located on any one zoning lot of record.
7.   Lots Unserved by Sewer. In any residentially zoned district where public sanitary sewer is not reasonably available, one single-family detached dwelling may be constructed, provided, the otherwise specified lot area and width requirements will be a minimum of 20,000 square feet, and 100 feet respectively, subject to the suitability of the lot for on-site sewerage disposal, and provided the housing meets all requirements of the Iowa Department of Public Health.
8.   Attached Accessory Structures. Construction of an accessory structure, that is attached or adjoining the principal building, must be constructed of a comparable, similar, or complimentary material as the adjacent or adjoining principal building.
