170.49 YARD

EXCEPTIONS AND MODIFICATIONS.

The following general exceptions and modifications will be permitted in and apply to all yards:
1.   Open terraces, decks, and patios, where the top of the upper-most walking surface of the structure is not over 30 inches above the grade and the top of the standard protective fall rail is not over 36 inches above the upper-most walking surface and are at least five feet from every lot line. This exception does not include permanently roofed structures. Parking, driveways, and walks not greater than 50 inches wide that connect to a public right-of-way and are at least five feet from a residential property line and are subject to provisions contained elsewhere in this code.
2.   Awnings and canopies that project not more than 10 feet out from the structure and that are at least seven feet above the average level of the adjoining ground;
3.   Chimneys that project not more than 18 inches into the yard;
4.   Arbors, trellises, flagpoles, fountains, sculptures, plant boxes, and other similar ornamental objects;
5.   Retaining Walls. Retaining walls less than 30 inches high that are at least five feet from the property line.
6.   Television satellite dishes not more than 24 inches in diameter. No free-standing towers or antennas of any kind shall be permitted on any lot.
7.   Front Yards. The following general exceptions and modifications, which are at least five feet from every lot line and project not more than three feet into the yard, will be permitted in and apply to all front yards:
   A.   Uncovered porches, steps, attached decks, verandas, or balconies where the top of the upper-most walking surface of the structure is not over one story high and the top of the standard protective fall rail is at least 36 inches above the upper most walking surface, one story bay windows, chimneys, flues, belt courses, leaders, sills, pilasters, plantings, or similar features.
   B.   In any district where the average depth of two or more existing front yards on lots within 100 feet of the lot in question and within the same block front is less or greater than the least front yard depth prescribed, front yards may be varied by the Building and Zoning Enforcement Officer for first time, new construction only. If varied, the depth of the front yard on said lot will not be less than the average depth of the other existing front yards or the average depth of the two lots immediately adjoining or, in the case of a corner lot, the depth of the front yard on the lot immediately adjoining; provided, however, that the depth of a front yard on a lot in any residential district will be at least 20 feet and will not exceed 60 feet.
8.   Side Yards. The following general exceptions and modifications will be permitted in and apply to all side yards:
   A.   Along any district boundary line, any abutting side yard on a lot in the less restricted district will have at least a width equal to that required in the more restrictive district. Where a lot in an industrially zoned district abuts a lot in a residentially zoned district, the side yard will be increased by three feet for each story that the building proposed on such lot exceeds the height limit of the said residentially zoned district.
   B.   On a corner lot the least width of a side yard along the side street lot line will be equal to the required front yard along the side street. No part of any accessory building will be nearer a side street lot line than the least depth of any front yard required along such side street.
   C.   Accessory buildings or structures subject to the provisions contained elsewhere in this Zoning Code.
   D.   Fences, plantings, or walls not over six feet above the average natural grade.
   E.   Fire escapes, not less than five feet from the side lot line. Bay windows which project not more than three feet from the building, provided these projections are entirely within planes drawn from either main corner of the side wall, making an interior angle of 22.5 degrees in the horizontal plane with the side wall. The sum of the lengths of such projection will not exceed one-third of the length of the wall of the main building.
   F.   Chimneys, flues, belt courses, leaders, sills, pilasters, and lintels, ornamental features, cornices, gutters, and the like into or over a required side yard not more than one and one-half feet.
   G.   Terraces, steps, uncovered porches, verandas, stoops, balconies, or similar features, not higher than the elevation of the first story of the building and which features are not less than five feet from a side lot line.
   H.   Whenever a lot of record has an average width that is 20 or more percent less than the minimum average width required in the district in which it is located, the width of the side yard may be reduced to 10 percent of the average width of the lot but will not be reduced to a width less than five feet in residentially zoned districts.
9.   Rear Yards. The following general exceptions and modifications will be permitted in and apply to all rear yards:
   A.   Fences, plantings, or walls not over six feet above the average natural grade.
   B.   Accessory buildings or structures, which are not over nine feet in height, which are not placed any closer than six feet to the rear lot line, and which are subject to the provisions contained elsewhere in this Zoning Code.
   C.   Fire escapes, bays, balconies, chimneys, flues, belt courses, leaders, sills, pilasters, lintels, ornamental features, cornices, eaves, terraces, steps, attached decks, porches, and the like provided that they are at least 10 feet from rear lot lines.
   D.   On any lot of record, created prior to August 16, 1961, the rear yard depth may be varied from that required herein by the Building and Zoning Enforcement Officer down to a minimum of not less than six feet.
