18.25 LOTS

PARCELS, AND BUILDINGS ON A PRIVATE STREET

18.25.010 Purpose

The purpose of this chapter is to establish minimum development regulations for lots and buildings on existing and new private street or lane. Private streets existing prior to the adoption of this code shall otherwise be determined as an existing private street and subject to the requirements of this chapter.

18.25.020 Development Standards

All private streets shall be constructed to City standards, and development on lots or parcels along private streets are subject to the development standards of the underlying zone, except as provided below:

  1. A new private street may not extend more than 400 feet in length. An existing private street may be extended up to a total length of 400 feet.
  2. The minimum width of a private street shall be:
    1. Existing Private Street: minimum pavement width is 20 feet, plus required curb, gutter, and sidewalk.
    2. New Private Street: minimum pavement width is 25 feet, plus required curb, gutter, and sidewalk.
  3. Any lot or parcel fronting on a private street shall be the minimum lot or parcel width and area requirements of the underlying zone.
  4. The minimum setback for buildings on lots or parcels on a private street shall be the minimum setbacks required of the underlying zone measured from edge of private street.

18.25.030 Required Improvements

Any development on a lot or parcel on a private street requires the following improvements, subject to adopted engineering standards set forth in MKC Title 14:

  1. Curb
  2. Gutter
  3. Sidewalk. At a minimum, sidewalk shall be installed on one side of the private street connecting the lot or parcel on which development is occurring to the public right-of-way.
  4. Turnaround. All private streets shall include a turnaround that satisfies the standards for turnarounds set forth in MKC 14.20.090, located at the farthest end of the private street.

18.25.040 Maintenance Of Private Streets

Recorded maintenance agreements for private right-of-way maintenance are required between the property owners and shall include an owner-funded system of regular road maintenance that addresses surfacing, snow removal, and potential replacement. A maintenance agreement shall be recorded as part of a plat approval, when applicable. If no plat is required prior to development, a maintenance agreement shall be recorded prior to obtaining a building permit.
