18.26 DIVISION

OF LEGALLY-ESTABLISHED TWO-HOUSEHOLD DWELLINGS

18.26.010 Purpose

The purpose of this chapter is to provide for the subdivision existing legally-established two-household dwellings, to promote affordable homeownership in Millcreek.

18.26.020 Applicability

Any lot or parcel containing a legally-established two-household dwelling, configured in a manner that the dwelling units are side-by-side, may be subdivided, creating a new lot line along the shared common wall and extending to the front and rear lot lines.

18.26.030 Requirements

  1. It is the applicant’s burden to demonstrate that a two-household dwelling meets the definition of a legally-established dwelling. If the two-household dwelling does not comply with the use or development standards in the underlying zone, the applicant shall obtain a nonconformities determination following the procedure as set forth in MKZ 18.15.040, before applying for a minor subdivision to divide a legally-established two-household dwelling.
  2. The division of a legally-established two-household dwelling shall follow the process for a Minor Subdivision, as set forth in MKZ 18.15.020 (A).
  3. Dedication of required right-of-way or installation of frontage improvements is required as part of a minor subdivision application for the division of a legally-established two-household dwelling.
  4. The subdivision plat shall specifically note that the purpose of the subdivision is to accommodate the division of a legally-established two-household dwelling.
  5. All necessary deeds, easements, and agreements shall be executed and submitted to the City prior to the recording of a plat that divides a legally-established two-household dwelling.
