Fredericksburg City Zoning Code

Sec. 7.150

Lapse of Approval.

Unless a longer time shall be specifically established as a condition of approval, a Site Plan approval shall lapse and become void two (2) years following the date on which such approval became effective unless, prior to the expiration of two (2) years a building permit is issued and construction is commenced and diligently pursued toward completion, or a certificate of occupancy is issued for the use, or the site is occupied in accordance with the Site Plan if no building permit or certificate of occupancy is required.

A Site Plan approval may be renewed by the Planning and Zoning Commission for an additional period of one (1) year, provided that prior to the expiration date, a written request for renewal is filed with the Director of Planning and Building. The application may be granted by the Planning and Zoning Commission upon its determination that no significant changes have occurred in the application of the criteria established in Section 7.131 above.
