In the event of any questions as to the appropriate use classification of any existing or proposed use or activity, the Director of Planning and Building shall have the authority to determine the appropriate classification subject to the right of appeal to the Planning and Zoning Commission. In making such determinations, the Director of Planning and Building shall consider the characteristics of the particular use in question, and shall consider any functional, product, service, or physical facility requirements common with or similar to uses cited as examples of use classifications. The Director of Planning and Building shall bring before the Planning and Zoning Commission all appeals that are on file within 40 days of filing. The Planning and Zoning Commission shall make a determination of the appropriate classification.
