§ 13-6.18

Fences.

Fences shall be permitted in the front, side and rear yards, within the Township of Lafayette, subject to the following regulations:
a. 
The height of any fence in a rear or side yard shall be no greater than six feet;
b. 
The height of any fence in a front yard shall be no greater than four feet;
c. 
All fences shall be constructed with the "good side"/uniform fencing facing out. Fence posts shall be located on the inside of the fence;
d. 
All fencing shall be set back a minimum of six inches from the property line.
e. 
At least 50% of the fence shall remain open for all fences located in the front yard.
f. 
Fencing utilized for generally accepted agricultural purposes shall be exempt from this chapter, provided such fencing is in compliance with generally accepted agricultural standards, as determined by the Township Zoning Officer; and such agricultural fencing shall only be permitted so long as active agricultural use is on-going, and once agricultural uses cease, fencing shall be required to be in compliance with Township ordinances.
g. 
A fence permit shall be required for any fence installed in the Township within 10 feet of a property line. The Land Use Board Administrator shall create and maintain an application form that requires submission of a survey with the proposed fencing depicted on it and a picture or drawing of the proposed fencing sufficient for the Township Zoning Officer to determine compliance with this § 13-6.18. The Township Zoning Officer shall issue a fence permit after reviewing a completed application and determining that the proposed fencing will not encroach upon any neighboring lot line, easement or right of way and that the proposed fencing will be in compliance with this § 13-6.18. An application fee of $35 for residential and $75 for nonresidential shall accompany the fence permit application.
