§ LU-143.16

Criteria for Exceptions.

[Ord. No. 90-01 § 2]
a. 
Exceptions may be granted for the reconstruction, rehabilitation or restoration of structures listed on the National Register of Historic Places or the State Inventory of Historic Places, without regard to the strict application of the standards set forth in the remainder of this subsection.
b. 
Exceptions shall not be granted within any floodway if any increase in flood levels during the base flood discharge would result.
c. 
Exceptions shall only be granted upon a determination that the exception is the minimum necessary, considering the flood hazard, to afford relief.
d. 
Exceptions shall only be granted upon:
1. 
A showing of good and sufficient cause.
2. 
A determination that failure to grant the exception would result in exceptional hardship to the applicant.
3. 
A determination that the granting of an exception will not result in increased flood heights, additional threats to public safety or extraordinary public expense or create nuisances, cause fraud or victimization of the public or conflict with other existing provisions of this Ordinance.
