A.
There is hereby created a Community Planning and Preservation Commission (CPPC) to act as the Design Review Board and Local Planning Agency (LPA) for the purposes of and as required by the Community Planning Act and the Community Redevelopment Act of 1969. The CPPC as the LPA and, where required, the County Planning Council shall act upon all proposed amendments to the Comprehensive Plan and any element or portion thereof in all cases in which LPA review and recommendations are required by the Community Planning Act and the Community Redevelopment Act of 1969.
B.
The CPPC shall also consider long-range issues that are of current interest to the community, identified in the Vision 2020 Plan or other community-wide planning activity.
C.
The CPPC shall act on historic and archaeological matters, including acting as the Land Development Regulation Commission (LDRC) for the purposes of and as required by the Community Planning Act to review and evaluate proposed modifications to the Land Development Regulations related to historic and archaeological preservation, to review and evaluate proposed historic designations, certificates of appropriateness and any other action to be performed pursuant to the Historic and Archaeological Preservation Overlay Section, and perform all other duties required by the City of St. Petersburg's Certified Local Government Statutes awarded by the State.
D.
The CPPC shall also hear certain appeals where specifically required by this chapter.
E.
The CPPC shall have such other duties and responsibilities as are delegated to it under this chapter.

B.
In making appointments to the CPPC, the Mayor and City Council should seek a membership with diverse economic, geographic, social and professional representation and, where possible, should include members qualified and experienced in the fields of architecture, planning, landscape architecture, engineering, construction, and land use law and real estate.

The CPPC may, subject to City Council approval and consistent with appropriate budgetary procedures, recommend the securing of technical and professional services as may be necessary to facilitate the work of the CPPC.

There is hereby created a Development Review Commission (DRC) to act as the Design Review Board and evaluate and act on the development proposals within the City in order to ensure compliance with the Comprehensive Plan, zoning ordinance and other appropriate City regulations, to act as the Land Development Regulation Commission (LDRC) for the purposes of and as required by the Local Government Comprehensive Planning and Land Development Regulation Act to review and evaluate proposed modifications to the Land Development Regulations, except as to certain historic and archaeological preservation matters where the Community Planning and Preservation Commission will serve as the LDRC, and to act as the Airport Zoning Commission for the purposes of and as required by F.S., Ch. 333, Airport Zoning, to review certain airport obstruction permits and decide appeals.
B.
The DRC shall hear certain appeals where specifically required by this chapter.
C.
The DRC shall have such other duties and responsibilities as are delegated to it under this chapter.

Each regular member of each commission shall serve for a three-year term beginning on the date the resolution approving the regular member's appointment is finalized.
B.
Each alternate member of each commission shall serve for a three-year term beginning on the date the resolution approving the appointment of the alternate member is finalized. October 1; An alternate member shall serve in the place of a regular member during a commission meeting in the absence of the regular member or when the regular member cannot vote upon an item of business due to a conflict of interest. When participating in the place of a regular member, the alternate member shall have all the rights and responsibilities of a regular member. Alternate members shall be allowed to participate in all matters considered by the Commission regardless of whether they are eligible to vote on the matter under consideration. If an alternate member is appointed as a regular member during the alternate member's three-year term, the start date and duration of their term as a regular member shall be pursuant to subsection A. above.
C.
Each new regular or alternate member shall be allowed to participate in all matters considered by the Commission but shall be prohibited from voting prior to receiving and completing new member training, which shall be provided by the POD following appointment of the members.
D.
Regular members may serve no more than two consecutive full terms on any commission. Service as an alternate member or service for the remainder of an unexpired term shall not be counted in determining this limitation. No person shall serve as a regular or alternate member on two or more commissions at the same time.
E.
The Mayor may remove from office any regular member of a commission for absenteeism in accordance with section 2-338.

A regular meeting schedule shall be set by each commission. A special meeting may be called by the chairperson or a majority of the regular members of the Commission.
B.
No meeting of a commission may be called to order, nor may any business be transacted, without a quorum of a commission. A quorum shall mean that at least five members of the Commission are present and eligible to vote.
C.
All actions of a commission shall require the concurring vote of at least four members of the Commission except when a supermajority vote is required, in which case the concurring vote of at least five members of the Commission shall be required.
D.
If less than seven members of a commission are present at a meeting, including alternate members who may be sitting in the place of regular members, an applicant shall have the right to request and obtain a continuance of the hearing of the application for consideration until the next regularly scheduled meeting of the Commission. In such cases a request for continuance shall be made by the applicant when the application is called for consideration, prior to the presentation of any facts concerning the application. The Commission may decide whether to receive comments of persons in attendance before rescheduling the case. The applicant shall be responsible for providing notice of the rescheduled public hearing due to such a continuance. Provided, however, that if seven members are present, but one or more members are unable to vote because of a conflict of interest, the applicant shall not have the right to obtain a continuance. A continuance requested pursuant to this subsection shall not be granted over the property owners objections.

The Mayor should provide such support staff and services to each commission as may be necessary to assist the Commission in the performance of its duties, subject to the availability of funding for such assistance.

All meetings of each commission shall be open to the public and conducted in accordance with Florida law. All written, audio, visual and other records of the proceedings shall be open to inspection and copying in accordance with Florida's public records law.
