50.100.- COMMUNITY RESIDENTIAL HOME, SEVEN TO 14 RESIDENTS21

16.50.100.1.- Applicability.

This section shall apply to community residential home, seven to 14 residents, uses.

16.50.100.2. - Establishment.

Community residential home uses shall be allowed as provided in the Matrix: Use Permissions and Parking Requirements and shall comply with the development standards of the zoning district, the general development standards and this section.

16.50.100.3.1. - Seven to 14 residents.

A community residential home serving seven to 14 residents with necessary supportive staff is a multifamily residential use and shall be a permitted use in zoning districts permitting multifamily uses as required by F.S. ch. 419.

16.50.100.3.2. -

Such homes shall not be located within 1,200 feet of another community residential home nor within 50 feet of a property zoned NT or NS.

16.50.100.3.3. -

The sponsoring agency shall provide the POD with notification containing all of the information required by F.S. ch. 419 prior to occupancy of a structure.

16.50.100.3.4. -

A.

The POD shall review each notice and approve or deny the siting.

B.

If the POD fails to respond to the request within 60 days of receipt of the notice, the sponsoring agency may establish the home at the site selected.

16.50.100.3.5. - Criteria for denial.

The POD may deny the request if it:

1.

Does not meet the distance requirements herein.

2.

Does not comply with zoning regulations applicable to other multifamily uses in the district.

3.

Does not meet applicable licensing criteria established and determined by the sponsoring agency, including requirements that the home be located to ensure the safe care and supervision of all clients in the home.

16.50.100.3.6. -

To determine compliance with distance requirements, distances shall be measured from the nearest point of the existing home or property zoned NT or NS to the nearest point of the proposed home.

The sponsoring agency shall comply with all other requirements of F.S. ch. 419.

Requests for variances shall be reviewed by the Development Review Commission.
