50.240.- OUTDOOR SALES, ACCESSORY USE

16.50.240.1.- Applicability.

This section shall apply to outdoor sales, accessory uses.

16.50.240.2. - Establishment.

The establishment, expansion, or redevelopment of outdoor sales, accessory uses, shall be allowed as provided in the Matrix: Use Permissions and Parking Requirements and shall comply with the development standards of the zoning district, the general development standards and this section.

16.50.240.3. - Development standards.

A.

Additional paved off-street parking shall be provided as required by the zoning district.

B.

A paved loading area shall be provided in the interior side yard or rear yard to minimize visibility from the street.

C.

Loading areas shall be completely enclosed with a solid fence or wall at least six feet high.

The fence or wall shall comply with the height and design standards of the fences, walls and hedges section.

2.

Decorative masonry walls are required along sides of the property abutting residential uses. Fences are prohibited on such sides.

3.

The exterior of any fence or wall facing a street shall be landscaped as required by the landscaping and irrigation section.

16.50.240.4. - Use restrictions, for all areas.

A.

Outdoor sales shall be incidental to a principal use in the district in which outdoor sales is permitted. Only the business or entity occupying the principal structure may sell merchandise in the outdoor sales areas.

B.

Outdoor sales are prohibited in any yard that abuts a residential use or residential zoning district.

C.

Merchandise and display fixtures within an outdoor sales area shall not exceed five feet in height unless the fence or wall is allowed to be higher than six feet, then this height limit shall be one foot less than the allowed height of the fences or wall.

D.

Merchandise shall not be placed or located so as to interfere with pedestrian or building access or egress, required vehicular parking and accessible parking, aisles, access or egress, loading space parking or access, public or private utilities, services or drainage systems, fire lanes, alarms, hydrants, standpipes, or other fire protection equipment, or emergency access or egress.

E.

All tires that are stored or displayed outside shall be covered to prevent the accumulation of water.

16.50.240.5. - Additional use restrictions for non-sidewalk areas.

A.

Merchandise shall not be placed or located outside of areas specifically approved on the site plan.

B.

Outdoor sales areas shall not be located in any required parking spaces. Outdoor sales areas shall be considered part of the floor area of the principal use or structure for purposes of computing the required number of parking spaces.

C.

Outdoor sales areas shall comply with the architectural design requirements as set forth in the applicable zoning district.

D.

The addition of an outdoor sales area of 500 square feet or less shall require the installation of foundation landscaping. The addition of an outdoor sales area greater than 500 square feet shall require that the entire site be brought into compliance with current regulations for landscaping.

16.50.240.6. - Additional use restrictions for sidewalk areas.

A.

Sidewalk retail display is prohibited at any time the use in the abutting building is not open for business and is prohibited between the hours of 11:00 p.m. and 7:00 a.m.

B.

A minimum of one unobstructed pedestrian path at least four feet wide shall be maintained through the display area at all times. In areas of congested pedestrian activity, the POD may require a wider pedestrian path. Variances to this requirement shall not be granted.

C.

Unobstructed passage shall be provided from parking areas and public sidewalks to building entrances equal to the door width and at least a two-foot clearance on each side of the doorway.

D.

A minimum setback of at least four feet from the curb line shall be provided to maintain adequate space for pedestrian access to motor vehicles.

E.

Furniture, fixtures and equipment shall not be permanently anchored to the sidewalk nor shall they be attached or affixed to any tree, post, sign or other structure.

F.

Sidewalk retail display areas shall not exceed 100 square feet for all outdoor display areas.

G.

Merchandise and display fixtures within an outdoor sales area shall not exceed five feet in height when abutting the building and four feet when not abutting the building.

H.

Public sidewalks may only be used as provided in the sidewalk retail display section.
